Richard D. Bennett
Mr. Bennett’s practice is
concentrated in the areas of general civil and commercial litigation. Mr. Bennett’s primary areas of practice
includes construction contract and lien disputes and representing employers in
all aspects of employment and labor relations law, including appearances before
state and federal agencies, state and federal court litigation, and employer
counseling. He represents employers
charged with employment discrimination, wrongful termination, violations of the
FMLA, breach of contract, enforcement of covenants not to compete, claims of
overtime violations, and other wage and hour issues. He also handles contract negotiations,
collective bargaining disputes, arbitrations, union election campaigns and
unfair labor practice violations before the NLRB. Mr. Bennett’s other areas of practice include
government relations, business formation and counseling for small businesses. Mr. Bennett has represented clients before
numerous state and federal trial courts, Sixth and Eighth Courts of Appeals,
and before the U.S. Supreme Court. He is
also a member of the Society for Human Resources Management (SHRM) and serves
on the Board of Directors and as the General Counsel for the Associated
Builders and Contractors of West Tennessee.
Mr. Bennett is a
nationally recognized authority on employment law and has given numerous
seminars on employment related topics, including the issues related to the
FMLA, FLSA, NLRA, Title VII and other employment and labor laws. In 2002, he successfully argued the first
FMLA case heard by the U.S. Supreme Court representing the employer in Ragsdale v. Wolverine World Wide, Inc.
Mr. Bennett has also been
recognized as a Mid-South Super Lawyer by Super
Lawyers Magazine in the area of Employment Law and has been selected for
inclusion in The Best Lawyers in America,
19th edition in the area of Employment Law.
